SC refuses urgent hearing in BRS MLAs poaching case

The Supreme Court on Wednesday refused to grant ‘stay’ on the order of the Telagana High Court quashing the SIT and directing CBI probe into the BRS MLAs poaching case. The case will now be heard on February 17.

The government of Telangana has approached the apex court seeking stay on the high court order after the division bench of the high court dismissed the appeal filed by the state government challenging single bench order directing the state to hand over the case to CBI.

The apex court bench headed by Chief Justice of India, D Y Chandrachud also refused an urgent hearing saying that the case will be heard on February 17.

Meanwhile, Telangana High Court on Wednesday rejected state government’s plea to permit Justice B Vijaysen Reddy to hear the interim application in BRS MLAs poaching case.

It may be called the state government had approached the single bench on Tuesday seeking suspension of its order quashing the SIT and allowing CBI probe in the MLAs  poaching case, for a period of four weeks. The government had filed the interim application so that it can approach Supreme Court challenging the order of the single bench.

However, the single bench judge Vijaysen Reddy refused to take up the matter and directed the counsel for the state government to get permission from the division bench.

The division bench headed by Chief Justice Ujjal Bhuyan on Wednesday rejected the plea saying, “Single Judge has passed Orders on December 26 and against that order, the State preferred appeals before this Division Bench and this Court dismissed all those appeals as not maintainable on February 6. The order passed by the division bench is final and the single judge cannot invoke his jurisdiction and hear any plea in this case.”
